APPLICATION OF THESE TERMS

3.1 These Terms apply to all Promotions operated by Dream Car Competitions unless expressly stated otherwise.

3.2 Every Promotion will also have Specific Terms displayed on its Competition Page.

3.3 The Specific Terms may include:

  • The Prize;
  • Opening Date;
  • Closing Date;
  • Entry price;
  • Maximum number of Entries;
  • Maximum Entries per person;
  • Free Entry Route;
  • Geographic eligibility;
  • Draw date;
  • Prize collection or delivery arrangements;
  • Cash alternative, if available;
  • Any competition question;
  • Any special Prize conditions; and
  • Any other material condition applicable to that Promotion.

3.4 Entrants should read both these Terms and the Specific Terms before entering.

3.5 If there is a genuine conflict between these Terms and the Specific Terms, the Specific Terms will apply to that Promotion to the extent of that conflict, provided the Specific Terms comply with applicable law.

4. TYPES OF PROMOTION

Dream Car Competitions may operate different types of Promotion.

4.1 Prize Draws

A Prize Draw involves the random selection of a winning Entry from all valid Entries accepted into the draw.

Paid and valid Free Entry Route Entries will be included in the same pool and will have the same chance of winning per Entry.

4.2 Instant Win Promotions

An Instant Win Promotion uses a predetermined, random or independently verifiable prize allocation mechanism.

The Competition Page will explain the available Instant Win prizes and any material conditions applicable to them.

4.3 Skill or Knowledge Questions

Certain Promotions may include a question requiring skill, knowledge or judgement.

Where a question is required, the Competition Page will explain this.

Unless expressly stated otherwise, the existence of a question does not change the requirement that any applicable Free Entry Route must be treated in accordance with these Terms.

ELIGIBILITY

5.1 Entrants must be aged 18 years or over at the time of entry.

5.2 Unless otherwise stated on the Competition Page, Promotions are open to eligible residents of:

  • England;
  • Scotland;
  • Wales; and
  • Northern Ireland.

5.3 Residents of the Republic of Ireland may enter only where the relevant Competition Page expressly states that the Promotion is open to Republic of Ireland residents.

5.4 Where a Promotion is made available in the Republic of Ireland, Dream Car Competitions will operate that Promotion subject to applicable Irish law and any specific regulatory, licensing, entry or promotional requirements that apply.

5.5 Nothing in these Terms should be interpreted as making every Promotion automatically available in the Republic of Ireland.

5.6 The following persons may not enter unless expressly permitted by applicable law and the Specific Terms:

  • Employees of the Promoter directly involved in administering the Promotion;
  • Directors of the Promoter directly involved in administering the Promotion;
  • Persons materially involved in designing or administering the relevant draw system;
  • Members of the immediate household of any person directly responsible for conducting the relevant draw where their participation could reasonably compromise the integrity of the Promotion; and
  • Any person prohibited from participating by applicable law.

5.7 The Promoter may request evidence of:

  • Identity;
  • Age;
  • Address;
  • Residency;
  • Account ownership;
  • Payment ownership; or
  • Eligibility.

5.8 A Prize will not be released until any reasonably required eligibility and identity checks have been completed.

CUSTOMER ACCOUNTS

6.1 Entrants may be required to create an Account before entering.

6.2 Information supplied when registering must be accurate, complete and current.

6.3 Each individual may maintain only one personal Account unless the Promoter expressly agrees otherwise.

6.4 Accounts may not be:

  • Shared;
  • Sold;
  • Transferred;
  • Created using false information; or
  • Used on behalf of another individual in order to circumvent Entry limits.

6.5 Entrants are responsible for keeping their login credentials secure.

6.6 Dream Car Competitions may require additional verification where there are reasonable grounds to suspect:

  • Fraud;
  • Multiple Accounts;
  • Identity misuse;
  • Payment misuse;
  • Automated Entries;
  • Circumvention of Entry limits; or
  • Other abuse of a Promotion.

PAID ONLINE ENTRY

To enter using the paid online route, the Entrant must normally:

7.1 Visit the relevant Competition Page.

7.2 Review the Prize, price, Closing Date, maximum Entries and other Specific Terms.

7.3 Answer any required competition question.

7.4 Select the permitted number of Entries.

7.5 Log in or create an Account.

7.6 Confirm acceptance of these Terms and any Specific Terms.

7.7 Complete payment through an authorised payment method.

7.8 Receive confirmation that the Entry has been accepted.

An attempted payment or incomplete checkout does not constitute a valid Entry.

FREE POSTAL ENTRY — UNITED KINGDOM

8.1 Where a UK Promotion operates using both paid and free entry routes, no purchase is necessary to use the Free Entry Route.

8.2 The ordinary cost of sending a first-class or second-class postal communication is borne by the Entrant.

8.3 No payment for the Entry itself is made to Dream Car Competitions when using the Free Entry Route.

8.4 The Free Entry Route will be displayed clearly on the relevant Competition Page and will not be deliberately hidden only within these Terms.

8.5 Unless the Competition Page specifies another lawful free method, a postal Entry should be sent by ordinary first-class or second-class post.

8.6 Recorded delivery, Special Delivery, courier delivery or other enhanced delivery services are not required.

8.7 Postal Entries must be sent to the Free Entry address stated on the Website or Competition Page.

INFORMATION REQUIRED FOR A POSTAL ENTRY

Unless the Specific Terms state otherwise, each postal Entry must clearly include:

9.1 The Entrant's full legal name.

9.2 Date of birth.

9.3 Full residential postal address.

9.4 Email address associated with the Entrant's Dream Car Competitions Account.

9.5 Contact telephone number.

9.6 Exact name of the Promotion or the Promotion's unique reference number.

9.7 The Entrant's answer to any competition question required for online Entries.

9.8 Any other information clearly stated as necessary on the Competition Page.

9.9 The Entrant must have an active Dream Car Competitions Account containing details matching the postal Entry where an Account is required for that Promotion.

PROCESSING POSTAL ENTRIES

10.1 Each postal Entry must be submitted separately unless the Specific Terms expressly provide otherwise.

10.2 Where one Entry per postal communication is specified, multiple Entry requests contained in the same envelope or postcard will constitute one Entry only.

10.3 Entrants may submit multiple postal Entries up to the same applicable maximum Entry limit, provided every Entry separately complies with the Free Entry Route requirements.

10.4 Valid postal Entries will be allocated Entry Numbers from the same Entry pool used for paid Entries.

10.5 The method used to determine a winning Entry must not favour or discriminate against an Entry because it was submitted using the Free Entry Route.

10.6 Valid paid and free Entries therefore have the same chance of winning per Entry.

10.7 Postal Entries must be received by the Promoter before the applicable postal-entry deadline.

10.8 Proof of posting is not proof of receipt.

10.9 Dream Car Competitions is not responsible for postal items genuinely lost, damaged or delayed by a postal operator where the Promoter has not caused that loss or delay.

10.10 Postal Entries received after a Promotion has validly closed cannot be accepted.

10.11 Dream Car Competitions will process valid postal Entries fairly and without intentionally delaying them for the purpose of excluding free Entrants.

REPUBLIC OF IRELAND ENTRY ROUTES

11.1 A resident of the Republic of Ireland may participate only where the relevant Competition Page expressly states:

“Open to residents of the Republic of Ireland.”

11.2 The Competition Page will identify any Entry conditions or Entry Route specifically applicable to Republic of Ireland Entrants.

11.3 Where Irish legal or regulatory requirements differ from those applicable in the United Kingdom, the Promoter may operate different lawful entry mechanics for Republic of Ireland residents.

11.4 Dream Car Competitions will not represent a UK Free Entry Route as automatically satisfying Irish gambling, lottery or promotional legislation.

11.5 Any mandatory rights of an Entrant under Irish law remain unaffected by these Terms.

12. EQUAL TREATMENT OF ENTRY ROUTES

12.1 Where both paid and Free Entry Routes are offered, valid Entries must be treated equally when determining winners.

12.2 The draw system must not:

  • Weight paid Entries more favourably;
  • Weight free Entries less favourably;
  • Exclude valid free Entries from the draw;
  • Allocate inferior numbers to free Entries; or
  • Otherwise distinguish between the Entry methods when selecting a winner.

12.3 One valid Entry represents one chance of winning unless the Specific Terms clearly and lawfully state otherwise.

ENTRY NUMBERS

13.1 Every accepted Entry will be allocated an Entry Number or other unique identifier.

13.2 Entry Numbers may be allocated automatically.

13.3 Entry Numbers do not have a monetary value and cannot be separately traded or transferred.

13.4 An Entry becomes valid only once it has been successfully accepted by the Promoter's system or, for postal Entries, processed and accepted by the Promoter.

13.5 The Promoter may display accepted Entry Numbers through the customer's Account and/or confirmation email.

ENTRY LIMITS

14.1 Each Promotion may have:

  • A maximum overall number of Entries; and/or
  • A maximum number of Entries permitted per person.

14.2 The applicable limits will be displayed on the Competition Page.

14.3 Paid and postal Entries submitted by the same individual will count together when calculating any individual Entry limit.

14.4 Creating additional Accounts, identities or payment profiles to circumvent Entry limits is prohibited.

14.5 Entries exceeding the applicable limit may be rejected or invalidated.

COMPETITION QUESTIONS

15.1 Where a Promotion requires an Entrant to answer a question, the required answer must be submitted before an Entry is accepted.

15.2 A postal Entrant must answer the same question where the question applies to the Promotion.

15.3 Incorrect answers may result in an Entry not being accepted where correct completion of the question is an express requirement of the Promotion.

15.4 Dream Car Competitions will not retrospectively change the correct answer after valid Entries have been accepted, except to correct an obvious error where fairness and applicable law permit.

OPENING AND CLOSING DATES

16.1 Each Promotion will clearly display its Opening Date and Closing Date.

16.2 Unless expressly stated otherwise, times are shown in UK local time.

16.3 Entries must be received and accepted before the applicable Closing Date.

16.4 Dream Car Competitions will not ordinarily extend or shorten a Closing Date after a Promotion has opened.

16.5 A Closing Date may be changed only where reasonably necessary due to circumstances such as:

  • A material technical failure;
  • An event outside the Promoter's reasonable control;
  • A legal or regulatory requirement;
  • A serious security issue; or
  • Another exceptional circumstance where changing the date is necessary to administer the Promotion fairly.

16.6 A Closing Date will not be extended merely because the Promoter wishes to increase ticket sales.

16.7 Any permitted material change will be communicated clearly and as soon as reasonably practicable.

SELLOUT

17.1 A Promotion may close before its scheduled Closing Date if the clearly stated maximum number of Entries has been reached.

17.2 Where sellout is possible, this will be made clear on the Competition Page.

17.3 Once all available Entry Numbers have been validly allocated, no further paid or postal Entries can be accepted.

17.4 The Promoter will not deliberately withhold Entry Numbers from Free Entry Route participants for the purpose of ensuring that they are sold through the paid route.

STANDARD PRIZE DRAW — WINNER SELECTION

18.1 After the Promotion closes, a winner will be selected from all valid Entries accepted into the relevant draw.

18.2 The winner will be selected through:

  • A computer process capable of producing verifiably random results; or
  • Another fair random process conducted by, or under the supervision of, an appropriately independent person where required.

18.3 The Promoter will maintain appropriate records demonstrating the integrity of the draw.

18.4 Paid and valid free Entries will be contained within the same eligible Entry pool.

18.5 The Entry method will not affect the chance of selection.

18.6 The Promoter's records of valid Entries will be used to administer the draw, subject to correction of demonstrable administrative or technical errors.

LIVE DRAWS

19.1 Dream Car Competitions may broadcast draws live through its Website or social-media channels.

19.2 Where a draw is not broadcast live, the Promoter may record and subsequently publish the draw.

19.3 A live broadcast is an additional transparency measure and is not, by itself, a condition of a valid draw unless expressly stated in the Specific Terms.

19.4 Technical failure of a livestream does not invalidate a properly conducted and verifiable draw.

INSTANT WIN PROMOTIONS

20.1 Instant Win prizes will be allocated using a fair, random or independently verified allocation mechanism.

20.2 The Competition Page will identify:

  • Available prizes;
  • Number of available prizes where applicable;
  • Entry period;
  • Claim requirements; and
  • Other material Instant Win conditions.

20.3 An Entrant will be notified of an Instant Win result through the Website, Account, email or another stated method.

20.4 Winning numbers, winning moments or other prize allocations must be generated or allocated fairly.

20.5 The Promoter will maintain appropriate evidence demonstrating that Instant Win prizes were distributed or made available for distribution using the stated mechanism.

20.6 A winning Instant Win Entry remains subject to:

  • Eligibility verification;
  • Identity verification;
  • Compliance with these Terms; and
  • Any lawful Prize claim requirements.

20.7 A Prize may not be refused simply because the winning Entry was made using a valid Free Entry Route.

PRIZES

21.1 The Prize for each Promotion will be described on its Competition Page.

21.2 Dream Car Competitions will take reasonable steps to describe the Prize accurately.

21.3 Photographs may be used for illustrative purposes, but any material difference between an image and the actual Prize will be disclosed where reasonably relevant.

21.4 Unless clearly stated otherwise, a Prize cannot be exchanged by the winner for another Prize.

21.5 Where a cash alternative is available, its amount or method of calculation will be stated on the Competition Page.

21.6 The Promoter is not obliged to provide a cash alternative unless one is expressly offered.

21.7 A failure to achieve a desired level of paid ticket sales will not, by itself, entitle the Promoter to withhold an advertised Prize or materially reduce its value unless a lawful and sufficiently prominent condition explaining that arrangement was disclosed to Entrants before Entry.

21.8 The Promoter may substitute a Prize only where genuinely necessary for circumstances outside its reasonable control and where permitted by applicable law.

21.9 Any substituted Prize will, wherever reasonably possible, be of equivalent or greater value and broadly equivalent character.

VEHICLE PRIZES

Where the Prize is a motor vehicle, the Competition Page should state relevant material information including, where applicable:

22.1 Make and model.

22.2 Model year.

22.3 Registration year.

22.4 Approximate mileage for a used vehicle.

22.5 Whether the vehicle is new or used.

22.6 Material modifications.

22.7 Material known defects.

22.8 General vehicle condition.

22.9 Any warranty supplied.

22.10 Any cash alternative.

22.11 Vehicle location.

22.12 Collection or delivery arrangements.

22.13 Whether registration or transfer fees are included.

22.14 Any geographic restrictions affecting delivery.

22.15 Any Irish importation, registration, customs, VAT, VRT or related obligations that may arise where a vehicle is transferred to a Republic of Ireland winner.

22.16 The winner is responsible for obtaining legally required insurance before driving a vehicle on a public road.

22.17 Unless the Competition Page expressly states otherwise, the winner is responsible for normal costs arising after legal transfer of the vehicle, including insurance, fuel, maintenance, servicing and future taxation.

22.18 A winner must hold any licence legally required to drive the vehicle if they intend to drive it.

22.19 A winner who does not hold a driving licence may still be able to own the vehicle where permitted by law, but must arrange lawful collection or transport.

CASH PRIZES

23.1 Cash Prizes will be paid only through a payment method reasonably approved by Dream Car Competitions.

23.2 The Promoter may require the recipient's identity and bank-account ownership to be verified.

23.3 Payment will normally be made only to an account in the verified winner's name unless applicable law or exceptional circumstances permit otherwise.

23.4 Winners are responsible for obtaining their own tax advice regarding any personal tax consequences arising from receipt, ownership or disposal of a Prize.

WINNER CONTACT

24.1 Dream Car Competitions will attempt to contact a winner using the information associated with the winning Account or Entry.

24.2 We may contact a winner by:

  • Telephone;
  • Email;
  • Account notification; and/or
  • Another reasonable method.

24.3 Entrants are responsible for maintaining current contact information.

24.4 Dream Car Competitions will make reasonable efforts to contact the winner.

WINNER VERIFICATION

25.1 Before releasing a Prize, the Promoter may require evidence reasonably necessary to verify:

  • Name;
  • Date of birth;
  • Address;
  • Residency;
  • Identity;
  • Account ownership;
  • Entry validity;
  • Compliance with Entry limits; and
  • Eligibility.

25.2 A winning Entry may be declared invalid where there is clear evidence of:

  • Fraud;
  • False identity;
  • Manipulation;
  • Multiple Account abuse;
  • Circumvention of Entry limits;
  • Payment fraud;
  • Automated or prohibited Entry methods; or
  • A material breach of these Terms.

25.3 Disqualification will not be used arbitrarily.

CLAIMING A PRIZE

26.1 Winners must follow the reasonable claim instructions provided by the Promoter.

26.2 Winners will not be required to make a premium-rate payment merely to discover that they have won or to claim the Prize.

26.3 Unless otherwise required by law or stated in the Specific Terms, winners should respond within 14 days of the Promoter's first successful notification attempt.

26.4 Where a winner does not respond, Dream Car Competitions will make reasonable further attempts to contact them.

26.5 A Prize will not automatically be forfeited merely because the winner fails to answer a single telephone call or email.

26.6 If a winner cannot be located or fails to claim a Prize despite reasonable efforts and the applicable claim period has expired, the Promoter may select another winner where permitted by law and the Specific Terms.

26.7 Any redraw will be conducted fairly from eligible valid Entries.

WINNER ANNOUNCEMENTS AND PUBLICITY

27.1 Dream Car Competitions may publish information reasonably necessary to demonstrate that a valid Prize has been awarded, subject to data protection law.

27.2 This may include limited information such as:

  • Winner's first name;
  • Surname initial;
  • General county or region;
  • Winning Entry Number; and
  • Prize won.

27.3 Additional photographs, video interviews, vehicle-handover content or testimonials may be requested separately.

27.4 Where consent is legally required for promotional content, the Promoter will seek the appropriate consent.

27.5 A winner may contact Dream Car Competitions regarding legitimate privacy or safety concerns.

PRIZE COLLECTION AND DELIVERY

28.1 Collection or delivery arrangements will depend on the Prize.

28.2 Material delivery restrictions will be disclosed before Entry where reasonably foreseeable.

28.3 Vehicle winners may be required to attend a handover location or arrange transport.

28.4 Where Dream Car Competitions agrees to provide delivery, the agreed delivery arrangements will be confirmed directly with the winner.

28.5 The point at which responsibility for the Prize transfers to the winner will be communicated where materially relevant.

REFUNDS AND CANCELLATIONS

29.1 Entries are generally final once successfully accepted into a Promotion, subject always to applicable consumer law.

29.2 Refunds may be provided where:

  • Dream Car Competitions cancels a Promotion without awarding the advertised or lawful substitute Prize;
  • A duplicate payment results from a verified technical error;
  • A payment is taken but no corresponding Entries are capable of being provided;
  • A refund is required by law; or
  • Dream Car Competitions determines that a refund is appropriate in exceptional circumstances.

29.3 Changing your mind after valid Entries have been accepted will not automatically entitle you to a refund where applicable law does not require one.

29.4 Nothing in these Terms limits any mandatory consumer cancellation or refund right that applies by law.

29.5 Ordinary postage costs associated with a Free Entry Route are not payments made to Dream Car Competitions and cannot be refunded by the Promoter.

PROMOTION CANCELLATION

30.1 Dream Car Competitions may cancel, suspend or materially modify a Promotion only where reasonably necessary.

30.2 Circumstances may include:

  • Serious technical failure;
  • Security breach;
  • Fraud or attempted manipulation;
  • Legal or regulatory requirement;
  • Loss or destruction of a unique Prize;
  • Force majeure; or
  • Another event outside the Promoter's reasonable control that prevents fair continuation.

30.3 Cancellation or modification will not be undertaken simply because paid ticket sales are lower than expected unless a clearly disclosed and lawful condition stated otherwise before customers entered.

30.4 Where a Promotion is cancelled, affected paid Entrants will receive an appropriate refund where required.

PAYMENT

31.1 Paid Entries must be made using payment methods accepted by Dream Car Competitions.

31.2 Payment processing may be provided by third-party payment providers.

31.3 An Entry is not guaranteed merely because a payment instruction has been submitted.

31.4 Payment must be successfully authorised and the Entry accepted before the applicable deadline.

31.5 Dream Car Competitions does not normally store complete payment-card details where they are processed directly by an authorised payment provider.

CHARGEBACKS

32.1 Entrants should contact Dream Car Competitions first where they believe a payment error has occurred.

32.2 Fraudulent or abusive chargebacks may result in investigation and Account restriction.

32.3 A genuine payment dispute will not automatically be treated as fraud.

32.4 Where payment relating to an Entry is lawfully reversed before the draw, the corresponding paid Entry may cease to be valid where permitted by law.

SUBSCRIPTIONS OR MEMBERSHIPS

33.1 Dream Car Competitions may introduce optional subscription or membership products.

33.2 Where offered, the applicable page will state clearly:

  • Price;
  • Billing frequency;
  • Benefits;
  • Number or type of Entries included, if any;
  • Renewal arrangements;
  • Cancellation method; and
  • Material limitations.

33.3 Recurring subscriptions will not be activated without appropriate customer agreement.

33.4 Where a subscription automatically renews, that fact will be clearly disclosed before purchase.

33.5 Customers may cancel in accordance with the subscription terms and applicable consumer law.

33.6 Cancellation will prevent future renewals but will not automatically invalidate Entries already properly allocated.

DISCOUNT CODES, BONUSES AND PROMOTIONS

34.1 Dream Car Competitions may offer:

  • Discount codes;
  • Promotional credits;
  • Bonus Entries;
  • Loyalty rewards;
  • Membership benefits; or
  • Similar offers.

34.2 Additional terms may apply.

34.3 Promotional benefits have no cash value unless expressly stated.

34.4 Dream Car Competitions may withdraw an offer where it has been obtained or used fraudulently.

34.5 Promoters will not use bonus mechanics to disguise material conditions or circumvent applicable Entry requirements.

TECHNICAL FAILURES

35.1 Dream Car Competitions will take reasonable measures to maintain the Website and Promotion systems.

35.2 We cannot guarantee uninterrupted availability at all times.

35.3 Where a material technical problem affects a Promotion, the Promoter will take reasonable steps to preserve fairness.

35.4 Where reasonably necessary this may include:

  • Pausing Entries;
  • Correcting an obvious system error;
  • Restoring valid Entry data;
  • Refunding affected payments; or
  • Rescheduling a draw.

35.5 Dream Car Competitions will not knowingly rely on a technical error to disadvantage one Entry Route over another.

FRAUD AND PROHIBITED CONDUCT

Entrants must not:

36.1 Provide deliberately false registration information.

36.2 Impersonate another person.

36.3 Create multiple Accounts to circumvent restrictions.

36.4 Manipulate the Website, payment system, Entry allocation or draw.

36.5 Use bots, scripts or unauthorised automated systems to enter.

36.6 Exploit a technical vulnerability or obvious pricing/Entry error.

36.7 Interfere with another customer's Account.

36.8 Engage in payment fraud or identity fraud.

36.9 Attempt to manipulate an Instant Win allocation.

36.10 Circumvent maximum Entry limits.

36.11 Dream Car Competitions may suspend or close an Account and invalidate affected Entries where there is reasonable, evidenced justification to do so.

RESPONSIBLE PARTICIPATION

37.1 Participation in Dream Car Competitions Promotions is optional.

37.2 Customers should participate within their own means.

37.3 Entrants should not treat participation as a source of income or investment.

37.4 Dream Car Competitions may implement reasonable customer-protection measures including:

  • Spend information;
  • Account limits;
  • Time-out functionality;
  • Self-exclusion or account closure options; or
  • Other measures consistent with applicable law or industry good practice.

LIMITATION OF LIABILITY

38.1 Nothing in these Terms excludes or limits liability where doing so would be unlawful.

38.2 In particular, nothing excludes liability for:

  • Death or personal injury caused by negligence where liability cannot lawfully be excluded;
  • Fraud or fraudulent misrepresentation; or
  • Any statutory consumer right which cannot lawfully be excluded.

38.3 Subject to clause 38.1, Dream Car Competitions will not be responsible for loss caused solely by events outside its reasonable control where it has taken reasonable measures to administer the Promotion fairly.

38.4 This may include genuine failures of:

  • Telecommunications networks;
  • Postal systems;
  • Third-party payment services;
  • Hosting infrastructure; or
  • Other independent third-party services.

38.5 This clause does not excuse Dream Car Competitions from liability for its own failure to administer a Promotion in accordance with applicable law or these Terms.

DATA PROTECTION

39.1 Personal data will be processed in accordance with the Dream Car Competitions Privacy Policy and applicable data protection legislation.

39.2 Personal information may be processed for purposes including:

  • Account administration;
  • Entry administration;
  • Payment processing;
  • Draw administration;
  • Winner verification;
  • Fraud prevention;
  • Prize fulfilment;
  • Legal and accounting requirements; and
  • Marketing where lawfully permitted.

39.3 Further information is available in the Dream Car Competitions Privacy Policy.

MARKETING

40.1 Entering a Promotion does not automatically mean an Entrant has consented to every form of direct marketing.

40.2 Marketing communications will be sent in accordance with applicable privacy and electronic-marketing law.

40.3 Entrants may unsubscribe from marketing communications through the methods provided.

40.4 Necessary transactional communications concerning Accounts, Entries, payments, security and Prizes are not marketing communications.

INTELLECTUAL PROPERTY

41.1 Dream Car Competitions owns or lawfully uses the intellectual property appearing on the Website.

41.2 Website content may not be commercially copied, reproduced or exploited without permission except where permitted by law.

41.3 Third-party vehicle manufacturers, logos and trademarks remain the property of their respective owners.

41.4 Unless expressly stated otherwise, Dream Car Competitions Promotions are not sponsored, endorsed or administered by the manufacturer of a Prize vehicle.

SOCIAL MEDIA

42.1 Promotions advertised through Facebook, Instagram, TikTok, YouTube or another third-party platform are operated by Dream Car Competitions unless expressly stated otherwise.

42.2 They are not sponsored, endorsed, administered by or associated with those platforms unless expressly stated.

42.3 Entrants release the relevant platform from responsibility to the extent permitted by applicable law.

42.4 The Promoter remains responsible for administering its own Promotion.

CHANGES TO THESE TERMS

43.1 Dream Car Competitions may update these general Terms from time to time.

43.2 Changes will apply prospectively unless a change is required by law or is necessary to correct an obvious error.

43.3 We will not retrospectively change material rules of an active Promotion in a way that unfairly disadvantages Entrants except where genuinely necessary and legally permitted.

43.4 Material changes affecting an active Promotion will be communicated appropriately.

43.5 The version applying when an Entry is made will normally continue to govern that Entry.

COMPLAINTS

44.1 Customers who have a concern regarding a Promotion should contact:

support@dreamcarcompetitions.com

44.2 Please provide:

  • Your name;
  • Account email;
  • Relevant Promotion;
  • Relevant Entry or order number where available; and
  • Details of the complaint.

44.3 Dream Car Competitions will investigate complaints fairly and respond within a reasonable period.

44.4 Nothing in this complaints procedure prevents a consumer from exercising statutory rights or contacting an applicable regulatory, advertising, consumer or legal authority.

UNITED KINGDOM LAW

45.1 For Entrants resident in England or Wales, these Terms are generally governed by the laws of England and Wales, subject to mandatory consumer protections.

45.2 Residents of Scotland and Northern Ireland retain any mandatory legal rights and protections applicable in their home jurisdiction.

45.3 Nothing in these Terms is intended to deprive a UK consumer of mandatory rights or the right to bring proceedings in a court which applicable consumer law permits.

REPUBLIC OF IRELAND LAW

46.1 Where a Promotion is expressly open to Republic of Ireland residents, participation by an Irish consumer is subject to applicable Irish law.

46.2 Nothing in these Terms removes any mandatory right available to a Republic of Ireland consumer.

46.3 Where Irish law requires a licence, permit, authorisation, alternative Promotion structure or particular Entry mechanism, the Promotion will be offered to Irish Entrants only where the Promoter has determined that the necessary legal requirements have been met.

46.4 Republic of Ireland Entrants may bring complaints or proceedings through any mechanism or court available to them under applicable Irish law.
